Question

English translation (unreviewed): What is Islam's ruling on those who work in banks and place their own money in them without taking interest on it?

From the text of the answer

English translation (unreviewed): There is no doubt that working in banks that deal in riba is not permissible, because it is helping them in sin and transgression. Allah, Glorified, says: “Help one another in righteousness and piety, and do not help one another in sin and transgression, and fear Allah; indeed Allah is severe in punishment” [al-Ma'idah: 2]. It is established from the Prophet ﷺ that he cursed the one who consumes riba, the one who feeds it, its writer and its two witnesses, and said: “They are all the same.” Reported by Muslim in his Sahih.

Question

English translation (unreviewed): A man deposited money in one of the usurious banks for a term. When he received his capital, they gave him a profit, and he is perplexed about this profit: what should he do?

From the text of the answer

English translation (unreviewed): Usurious banks should not be used for deposits except in case of necessity. If he deposits with them out of necessity, he should not take the profit, he should not take the interest, because it is riba and it is not lawful for him to take riba. But some scholars said: if he takes the interest that he did not stipulate and did not agree with them on, but they said, 'This interest is yours', and he takes it and spends it on a good cause, such as helping a poor person or repairing a road or the like of what benefits the Muslims, and does not eat it or mix it with his own money, but spends it on a good cause, then some scholars said that this is not objectionable, for the benefit of the Muslims and so that the Christians and others do not take it and spend it on disobedience to Allah. This is what some scholars said.

Question

English translation (unreviewed): What is the ruling on working in usurious banks and taking a salary from them? Many people now work with them, either not knowing the situation or knowing it. Give us your ruling, may Allah reward you.

From the text of the answer

English translation (unreviewed): Working in usurious banks is an evil and is not permissible. The Messenger ﷺ cursed the one who consumes riba, the one who feeds it, its writer and its two witnesses, and said: “They are all the same.” Working in banks in riba, and elsewhere than banks if it is in riba, is not permissible; riba and helping with it are not permitted, whether as a clerk, an accountant or anything else. And Allah is the One whose help is sought.

Question

English translation (unreviewed): I came to this good land more than five years ago, and I suffered and was extremely exhausted at the beginning. My sponsor had no work that would take me out of my narrow circumstances and need of money to run my life and spend on my family, parents and brothers. I looked for work and moved among more than four commercial firms, and finally I settled in one of the banks here in Riyadh.

(excerpt from the question)

From the text of the answer

English translation (unreviewed): Allah, Mighty and Majestic, made lawful for His servants what brings their salvation and meets their needs, and forbade them what harms them. The servant is not compelled to what Allah has forbidden him; rather he must strive to seek provision by lawful means. Employment in banks is helping them in sin and transgression, whether as an accountant, a clerk or anything else. So the believer must beware of that and keep away from banks, because Allah, Glorified, says: “Help one another in righteousness and piety, and do not help one another in sin and transgression” [al-Ma'idah: 2].

Evidence as the shaykh cited it

English translation (unreviewed): Cooperation with banks, or with highway robbers, thieves, cheats or bribe-takers is all cooperation in sin and transgression, so it is not permissible. What you received before that, before you knew, is yours as it passed; and what came after knowledge is not yours. Allah, Mighty and Majestic, says: “So whoever has received an admonition from his Lord and desists, he may keep what is past, and his affair rests with Allah; but whoever returns, those are the companions of the Fire, they will abide therein eternally” [al-Baqarah: 275].

English translation (unreviewed): What you must do is seek the lawful, and Allah will compensate you. The Prophet ﷺ said in the authentic hadith when he was asked which earning is best?

Question

English translation (unreviewed): What is the ruling on working in a bank because of need?

From the text of the answer

English translation (unreviewed): It is not permissible to work in banks. The usurious banks may not be worked in, because that is cooperation in sin and transgression, so dealing with them is not permissible. The Messenger cursed the one who consumes riba, the one who feeds it, its writer and its two witnesses, and said: “They are all the same.” The writer of riba and the witness to it are partners, and the one who helps them, whether as an accountant, a messenger or a cleaner, is helping them in their affliction.

Question

English translation (unreviewed): What is your view of the banks in which we put money? And which bank do you advise, O Shaykh?

From the text of the answer

English translation (unreviewed): As for putting money in banks, I do not think it should be put there except out of need, such as when a person fears for the money in his house and puts it in these banks because of that need. I say that it is permissible to put it in banks for need, because banks are not 100% riba, since they have many good dealings that are not forbidden; otherwise, if their dealings were 100% riba, we would say: even if your money were to burn, do not put it with them, because you would be partnering with them in riba.

Question

English translation (unreviewed): Is it correct for me to withdraw some or all of my money that was in the banks, in shares and the like, but I did not ask when to withdraw it or what to do with it; and if I keep it at home I truly do not feel safe about it. What is your view?

From the text of the answer

English translation (unreviewed): My view on that is that placing money in banks is of two kinds. The first: that he takes riba, that is, he gives the bank, say, ten thousand riyals and after a year takes eleven thousand; this is not permissible, because it is plain riba. The second: that he places it in the bank and takes no riba; for this it is better not to place it in the bank, because if he does, the bank expands, its money increases and its riba-based profits multiply.

Question

English translation (unreviewed): This letter came from 'Adil Ibrahim al-Hamud, al-Khobar. He says: I ask you to present this letter to his eminence Shaykh 'Abd al-'Aziz ibn 'Abdillah ibn Baz, may Allah reward you. — We are presenting it now to his eminence, brother 'Adil. — Respected Shaykh 'Abd al-'Aziz ibn 'Abdillah ibn Baz, may Allah grant you success: it is not hidden from you that we are passing these days through various trials, such that one of us may fall into one of them.

(excerpt from the question)

From the text of the answer

English translation (unreviewed): There is no doubt, dear questioner, that dealing with usurious banks is forbidden and helping them is forbidden. Banks that deal in riba may not be participated in or cooperated with, because that falls under His saying, Glorified: “and do not help one another in sin and transgression” [al-Ma'idah: 2]. So shares are not to be bought from them, and they are not to be helped with anything, because in this they would be helped in sin.

Question

English translation (unreviewed): Working with commercial shares?

From the text of the answer

English translation (unreviewed): If there is no riba in them, there is no harm. If they are shares in iron, in construction, in land, in cars, there is no harm; but riba, no. Q: Shares traded in banks? A: Banks, no, that is not acceptable. As for shares in which there is no riba, praise be to Allah: companies in which they participate in land, in cars, in equipment, in clothing; there is no harm.

Question

English translation (unreviewed): There are two kinds of buying and selling about whose validity people are doubtful today. We ask you to clarify the ruling on them, may Allah reward you. First: what is going on now in the al-Jafrah market in Riyadh, which is known to all, of borrowing with an increase. Second: modern trading in the international stock exchanges, especially as many people deal in them these days through the international banks newly opened in the Kingdom.

From the text of the answer

English translation (unreviewed): As for a loan with an increase, this is not permissible: for him to say, 'Give me five and I will give you six or seven', or 'Lend me a thousand and I will give you a thousand and twenty, or a thousand and thirty, or a thousand and forty', as banks and others do. This is an evil and is, without doubt, forbidden riba: that he borrows money with an increase, even if small, is not permissible.

Evidence as the shaykh cited it

English translation (unreviewed): Some people also err in this: he buys from a person who does not have the goods, then goes and buys them from someone else. No, no; do not buy goods except when they are owned by the one who sells them, who has taken possession of them in his shop or his house, then sells them to you; then you, when you buy them, also take possession of them and move them to your house or the market, and then sell them afterwards to whom Allah makes easy, and meet your need. As for the increase that is on you because of the deferral, Allah, Mighty and Majestic, will make it easy; the Prophet ﷺ said: “Whoever takes people's money intending to repay it, Allah will repay on his behalf.”

Question

English translation (unreviewed): Some people buy shares, not intending to trade in them, but they subscribe before allocation waiting for share prices to rise. What is your view? May Allah reward you.

From the text of the answer

English translation (unreviewed): In buying shares, we must know what it is that he wants to invest in. If it is something forbidden, such as banks, then investing in it is absolutely forbidden and nobody may invest in it. As for other investments, the default is that they are lawful until evidence shows that this investment is forbidden.
