The ruling on instalment sale and its conditions according to Ibn Baz

English translation (unreviewed): Now regarding a person who buys games (consoles) from someone, who says to him: 'I will sell you this game on instalments; instead of its value of forty thousand, buy it for seventy thousand in instalments.' Is this permissible?
- From the text of the answer
English translation (unreviewed): There is no harm in instalment sales. The people of Barirah sold Barirah herself on instalments — forty dirhams every year, nine instalments — in the time of the Prophet ﷺ. So instalment sale is fine when the terms are known: for example you buy a car worth thirty thousand for forty, or fifty, five thousand each year, or eight thousand each year, or a thousand each month; there is nothing wrong if it is known.

English translation (unreviewed): Your eminence, this questioner from the Emirates, al-'Ayn, who abbreviated his name (A. M. S.), says in this question: My brother bought a car, and they told him: if you pay the amount in one payment we reduce the price, and if you pay by instalments, a certain amount each month, we increase the price. From here I ask, your eminence: is it permissible for my brother to buy the car by instalments with the added charge? And is that considered riba?
- From the text of the answer
English translation (unreviewed): If they agree on this or on that, there is no harm. If they agree on cash there is no harm, and if they agree on known instalments there is no harm, so much each month, because of the saying of Allah, Glorified: “O you who believe, when you contract a debt for a specified term, write it down” [al-Baqarah: 282]. This covers instalments and a single payment, if they agree on that, a known amount each month or each year. And if they agree on cash, and part on cash for a known amount, there is no harm. But to part without having agreed on either this or that is not valid; they must be definite, either on cash or on deferral, before they part.
- Evidence as the shaykh cited it
English translation (unreviewed): The Shaykh: Allah, Glorified, says: “Allah has permitted trade and forbidden riba” [al-Baqarah: 275]. Sale is lawful if free from uncertainty, with a known price and a known item, or with a known term, there is no harm. But if the term is unknown, or the price unknown, or the item unknown, it is not valid. The item must be known and the price known, either in cash or deferred to a known term. Yes.

English translation (unreviewed): From 'Abd al-'Aziz ibn 'Abdillah ibn Baz, to the honourable brother, the esteemed editor-in-chief of the newspaper al-Jazirah, may Allah grant him success. Peace, mercy and blessings of Allah be upon you. (excerpt from the question)
- From the text of the answer
English translation (unreviewed): Sale for a known term is permissible, because of the general saying of the Most High: “O you who believe, when you contract a debt for a specified term, write it down...” the verse [al-Baqarah: 282]. An increase in the price in return for the term is not prohibited, for it is established from the Prophet ﷺ what indicates the permissibility of that: he ﷺ ordered 'Abdullah ibn 'Amr ibn al-'As, may Allah be pleased with them both, to equip an army, and he would buy a camel for two camels to a term.
- Evidence as the shaykh cited it
English translation (unreviewed): Both matters are impermissible, because it is established from the Prophet ﷺ that he said to Hakim ibn Hizam: “Do not sell what you do not have” [1].
English translation (unreviewed): Ibn 'Umar, may Allah be pleased with them both, said: “We used to buy food by estimate, so the Messenger of Allah ﷺ sent someone to forbid us from selling it until we moved it to our lodgings” [4].
English translation (unreviewed): It is also established from him, peace be upon him, that he forbade selling goods where they are bought until the merchants have taken them to their lodgings [5].

English translation (unreviewed): Your eminence, what are some of the prohibited ways in instalment sales?
- From the text of the answer
English translation (unreviewed): If he sells it to the one he bought it from: if he buys something on deferred instalments and then sells it for cash to the one he bought it from, this is called 'inah and is not permissible. But if he sells it to someone else, there is no harm: if he buys a car on instalments and then sells it to another, Zayd or 'Amr, for cash in order to marry, or to settle a debt, or to build a dwelling, there is no harm in that.

English translation (unreviewed): A man wanted to buy a house and did not have enough money to buy it, so he went to borrow, and he was told: we do not lend; rather we buy the house, then you repay us in instalments with an increase in the price. For example the house costs forty, and you repay us forty-five, and they said: this is in return for the period in which our money was tied up?
- From the text of the answer
English translation (unreviewed): There is no harm. If they sell him goods at an increase, there is no harm; this is a sale to a term. If they buy the house and then sell it to him for a known price to a known term, in one payment or in instalments, it is valid, and the scholars have stated it. So if the merchant buys the house for forty thousand and sells it to the one who needs it for forty-five thousand, or fifty thousand, to terms or to one term, there is no objection in that; or if he sells him sacks of sugar or sacks of food to a known term, there is no harm.

English translation (unreviewed): From al-Atawilah in al-Baha, this is a letter sent by the listener Sa'id Muhammad al-Zahrani. Our brother says: I sold a car to one of my friends for forty thousand riyals, to be paid in monthly instalments of a thousand riyals each. My friend is going through a financial crisis, so he asked me to sell it in the showroom since the car is still in my name. I took a promissory note for the price, and I stipulated to my friend that he be ...

English translation (unreviewed): Instalment sale is not objectionable if the instalments are known and the terms are known, because of the general saying of Allah: “O you who believe, when you contract a debt for a specified term, write it down” [al-Baqarah: 282]. Allah permitted debt to a specified term, so if the instalments are clear and known and the terms known, there is no harm, as you did with your friend: two thousand each month — this is something known, and the total is known, forty thousand. There is nothing wrong in this, provided that when you sold the car it was in your ownership and under your possession and control.

English translation (unreviewed): I and another person paid a sum of three hundred thousand riyals, and we buy new cars and put them in a showroom, and then when a buyer comes to us we sell them on instalments. We heard from the people of the town where we live that they did the same, that they asked you for a fatwa, and that you did not permit this?
- From the text of the answer
English translation (unreviewed): Yes. First, may Allah bless you: instalment sale sometimes comes like this: a person comes to you and says, 'I want a car', and you say, 'I have no cars; go to the showroom and choose any car and I will buy it in my name and transfer the money to the showroom, then I sell it to you in instalments at a higher price.' Did you understand this? This is forbidden, there is no problem about it:
- Evidence as the shaykh cited it
English translation (unreviewed): Second: that he did not buy this car except for the sake of riba, which is to sell it to him at a higher price; had it not been for the riba he would not have bought it. If he had come and said, 'May Allah reward you, lend me [the money] and buy the car for me and I will pay you later', he would not have agreed. And the Prophet ﷺ said: “Actions are only by intentions, and each person will have only what he intended.” That is one point.

English translation (unreviewed): Instalment sale of cars: a car comes to the showroom owner, then the showroom owner sells it to a person, and the person sells it on instalments to a third; the owner of the car who bought it sells it, and then it returns to the showroom owner again, and it may return to the showroom owner more than once or twice. What do you think of this?
- From the text of the answer
English translation (unreviewed): I see, first, that this transaction is not permissible: that a person comes to the merchant and says, 'I want a car from you on instalments', then the merchant orders him to go to the showroom and choose whatever cars he wishes, then he returns to the merchant and says, 'I choose such-and-such car', so the merchant buys it from the showroom and then sells it to this needy person. This is forbidden, and there is no doubt that it is a ruse. For instead of the merchant giving this man the value of the car in cash, and saying, 'The car's value is such-and-such in cash and more if over a year', there is no difference between this and his saying, 'Go and buy the car for me, then I will sell it to you.'

English translation (unreviewed): Instalment sale as widespread among people is forbidden; is there guidance to its lawful form, if dealing by instalments is in accordance with the Shari'ah?
- From the text of the answer
English translation (unreviewed): The lawful instalment sale is that one comes to the person who has the goods and says, 'Sell me these goods that are worth one hundred now for one hundred and fifty deferred for a year or two', for example. There is nothing wrong in this, because the Companions, may Allah be pleased with them, used to pay in advance for fruits for a year or two years, and the Prophet, may Allah's blessings and peace be upon him and his family, permitted them that. But to use a ruse — the merchant buys the goods, not wanting them at all, only wanting the riba in them — is not permissible, for there may be no ruse against what Allah has forbidden. On this basis we say to the needy brother: go yourself to the owner of the showroom and say to him, 'Sell me the car that you now sell for fifty, sell it to me for sixty over a year', and take the registration card and pledge the car if you fear that ...

English translation (unreviewed): Sale on instalments or deferred payment while he owns, for example, a car — this is the first matter; and the second matter: if the buyer wants to pay the rest of the price after a year or after a period, is anything charged for this period?
- From the text of the answer
English translation (unreviewed): He is asking two questions. The first question: Is it permissible to sell goods at a deferred price in instalments, a portion of the price falling due every year? This is permissible and there is no harm in it, because of the general saying of Allah, the Most High: “O you who believe, when you contract a debt for a specified term, write it down” [al-Baqarah: 282]; but the goods must be in the seller's possession.
